Privacy policy

This Privacy Policy describes how we use, store, disclose, and process information that we obtain about you through any of our sites or our services (“Personal Data”). This Privacy Policy applies to residents of the United States only. It aims to provide you with the reasons why and the conditions under which Gojob ("Gojob") collects and processes your Personal Data, in accordance with the California Consumer Privacy Act (CCPA) and other applicable law.

1.The data controller for your personal data

The entity which collects, organizes and processes your Personal Dataon Gojob websites and/or apps (the "Data Controller") is Gojob. The Data Controller’s Head Office is located at 220 rue de la Tramontane – 13090 Aix en Provence and you may direct any questions relating to your Personal Data to the e-mail address: dpo@gojob.com.

For the purposes of our relationship, Gojob will be responsible for all processing conducted in-house. However, the customer on whose behalf we are recruiting you may process some of your data in its own capacity as data controller, in particular:

  • to evaluate your candidacy (in this case, we share no responsibility for processing, as our involvement is reduced to a simple data transfer to which you have consented)
  • to sign a contract with us related to your job, in which your name will sometimes appear, for example (we are jointly responsible in this case, but you can direct any complaints you may have to us)
  • for any other organizational purpose of its own for which it shall be solely responsible (providing you with an access badge, organizing your tasks, etc.).

With regard to such processing operations, please refer to the privacy policy of the customer concerned.

What are the policies of linked websites and other third parties?

Gojob is present on social networks and has pages on Facebook, Twitter, Instagram and LinkedIn. For further information on the processing operations carried out in connection with these sites, please read the privacy policies that apply to these social networks.

Gojob uses Checkr as its third-party provider to run secure background checks on job candidates. For further information on Checkr’s terms of use and privacy policies, or the status of your background check, please contact Checkr, Inc. directly.

2. What types of information do we collect and how?

a. Categories of personal data commonly processed

By personal data, we mean any information which allows you to be directly or indirectly identified. Such data may include:

identification data:

  • on the Gojob websites, apps and systems: telephone number, e-mail address, password, IP address, login date and times, cookies, any correspondence you may have had with Gojob
  • in your relations with Gojob: first name(s) and last name, identification numbers (ID card, passport, social security number, internal personnel number, driving license, work permit), employment history, gender, date and place of birth, nationality, type, copy of work permit document, personal and professional physical, electronic and telephone contact details, photo and/or video, bank account number

data relating to training, work/jobs (conditions and dates of appointment, time sheet, current and past positions and grade, pay, disciplinary sanctions, absence data, workplace accidents and occupational illness and medical care, data on your performance and career development, particular constraints providing entitlement to special leave or a credit of time-off hours, honorary awards, training courses, identity and information about family members and/or emergency contacts)

data required for recruitment: curriculum vitae information (photo, date of birth, educational/academic background, skills, work experience, interests, salary expectations, etc.), cover letter (skills, personal and professional attributes, etc.) and possibly information on your personality (in the case of a personality test) or location and transport (such information making it possible to determine which jobs would best suit you)

and any other personal data required by law or current regulations.

b. Sources of personal data processed by Gojob or on its behalf

Gojob collects your Personal Data using one or more of the following methods:

  • directly from you
  • from Gojob partners
  • from Gojob members and customers (our customers)
  • from publicly available sources (job boards, in particular)
  • from certain third parties providing services to Gojob.

In each case, you will be informed of what happens to your Personal Data.

Furthermore, the Personal Data we require to fulfil the purposes below shall be marked with an asterisk (*) at every stage and in all of our forms.

3.1 Managing Gojob's information systems available to Internet users and Gojobbers (websites, apps, etc.)

Personal Data are collected solely for legitimate and relevant business purposes and every reasonably necessary measure is taken to ensure that the Personal Data is protected, accurate and up-to-date. Your Personal Data may be processed by Gojob for the following purposes:

3.1 Managing Gojob's information systems available to Internet users and Gojobbers (websites, apps, etc.)

When you visit our websites and/or apps and when you use the features we offer on these websites and/or apps, we measure your logins and behavior on our platforms (login and location data, pseudonyms, etc.), particularly for the purposes of ensuring our information systems (websites, apps, etc.) are secure and improving our knowledge of our users and our understanding of the quality of your experience on these systems.

We use cookies for this purpose, for example. In accordance with applicable law, we will sometimes obtain your consent, including for placing certain cookies on your browser, particularly those for audience measurement via third-party organizations.

The legal basis for processing Personal Data for the purposes referred to in this paragraph 3.1 is our legitimate interest in ensuring the information systems (websites, apps, etc.) are secure and managed properly.

3.2 Managing registrations on the Gojob websites and apps and the use of their features

Personal Data shall be processed for the following purposes:

  • managing your registration and identification on the platform
  • reviewing and recommending jobs
  • the functional management and optimization of the Gojob website and app.

Furthermore, we use your interactions and data on our websites and/or apps to provide you with the services on offer (interaction with you, input of hours worked, etc.)

The legal basis for processing personal data for the purposes referred to in paragraph 3.2 is the contract between us, in this case the General Terms and Conditions of Use of the Service (GTCU), which governs use of the features of the platform and our app.

3.3 Managing applications

You have provided us with Personal Data to be recruited for a temporary job, in response to an offer from us, published on a job board for example, or unsolicited. Providing this Personal Data is necessary so that your application can be examined.

Your Personal Data may be processed in particular for the following purposes:

  • to examine your application
  • to support your profile
  • to verify the information provided
  • to assess your skills for potential jobs
  • to reject your application or move it forward in the recruitment process
  • to add you to a Gojobber database
  • to examine and deal with any grievances or complaints.

The legal basis for processing personal data for the purposes referred to in paragraph 3.3 above is Gojob's legitimate interest in offering its customers the best possible candidates.

3.4 Managing the recruitment process

If we decide to continue the recruitment process, your Personal Data may be processed for the following purposes:

  • to invite you to attend one or more telephone interviews
  • to invite you to attend one or more interviews at our premises
  • to assess your skills and suitability for the position in question, possibly via a personality test, with candidates receiving specific notification of this, if applicable, or an analysis of previous appraisals of their performance by Gojob and/or its customers
  • to receive references from former employers
  • to examine and deal with any grievances or complaints.

If you are ultimately recruited for a job, the Personal Data referred to in the previous paragraph may also be processed for you to enter into and perform your employment contract.

The legal basis for processing Personal Data for the purposes referred to in paragraph 3.4 above is the potential employment contract which would ultimately result from your recruitment: the processing is therefore a necessary screening step to which you have consented.

3.5 Managing difficulties during applications or jobs

If any difficulties arise during our processing of your applications (incomplete or incorrect information, inappropriate attitude during interviews, etc.), or following your poor performance or non-performance of temp jobs you secure through Gojob, or if such jobs end earlier than anticipated, we may record these difficulties as part of a specific processing operation which may lead us to exclude you from certain offers. Should we decide to suspend your account or eligibility as a candidate for jobs on Gojob, we will notify you.

We will keep a record of your suspension, and the reason for it.

The legal basis for processing personal data for the purposes referred to in paragraph 3.5 above is our legitimate interest in connecting quality candidates to customers.

3.6 Managing Gojobber employment contracts and jobs

You have provided us with certain Personal Data in connection with the performance of jobs with partner companies.

Your Personal Data may be processed in particular for the following purposes:

  • to organize work (work schedules, job management, absence management, recruitment management, etc.)
  • to maintain and manage internal records (evaluations, relocations, promotions, etc.)
  • to examine and deal with any grievances, complaints, professional misconduct, breaches of contract or violation of Gojob codes or policies .

The legal basis for processing Personal Data for the purposes referred to in the paragraph above is the conclusion and/or performance of the employment contract and/or job contract.

3.7 Managing communications and marketing

When you register on the Gojob platforms, you provide us with your contact details (your mobile phone number or e-mail in particular). By downloading our mobile app available from Play Store or the App Store, you can also authorize us to display push notifications on your phone.

As stated in our General Terms and Conditions of Use, we will use your contact details to communicate with you in connection with the provision of our services.

Gojob may also use these contact details for other purposes, including marketing and/or sales prospecting, either with regard to products and services similar to those Gojob has already provided you with, or with your prior express consent.

You can unsubscribe from these communications at any time.

The legal basis for processing Personal Data for the purposes referred to in paragraph 3.4 above is our legitimate interest in using such data for prospecting purposes for the products and services we offer.

3.8 Managing in-house enquiries, audits and proceedings

Gojob may also process your Personal Data for the purposes of:

  • managing inquiries and/or in-house audits and/or external audits and actions to demonstrate or improve Gojob's compliance with its sector, partner and customer requirements, including with respect to information system security and personal data protection
  • carrying out activities related to the establishment or defense of the rights and interests of Gojob and/or its customers, particularly for the purposes of obtaining legal advice in connection with ongoing or potential legal proceedings involving Gojob or one of its customers.

The legal basis for processing personal data for the purposes referred to in paragraph 3.8 above is Gojob's legitimate interest in protecting itself and its customers from the legal risks associated with non-compliance with contractual or legal obligations.

3.9 Managing in-house enquiries, audits and proceedings

Gojob may also process your Personal Data for the purposes of:

  • establishing or maintaining compliance with the applicable law and regulations, particularly regarding employment, fiscal and accounting matters
  • cooperating in the context of or in readiness for proceedings, requests and enquiries by or from governmental, administrative, judicial or regulatory authorities involving Gojob and responding to any questions or requests from these authorities directed at Gojob.

The legal basis for processing Personal Data for the purposes referred to in paragraph 3.6 above is Gojob's compliance with the legal and/or regulatory obligations to which Gojob is subject.

3.10 Activities whereby you are promoting Gojob's image and services

Subject to your express consent, your Personal Data, and in particular your image, may be the subject of videos, photos, prints or publications and disseminated on the Internet and on the Gojob platforms, or may be used by Gojob for in-house or external use, for the following purposes:

  • for purposes of dissemination, communication, promotion and public relations
  • for purposes of dissemination to Gojob customers, users and suppliers, for example in communications, newsletters, brochures, catalogues and other presentations
  • for Gojob events organized in-house or externally, or even abroad
  • for reproduction and publication on the Internet and/or on any other type of electronic or non-electronic medium (including, by way of example, but not limited to, printing and brochures).

The legal basis for processing Personal Data for the purposes referred to in paragraph 3.10 above shall be your express prior consent (obtained in writing).

4. To whom do we disclose information collected about You? Personal data recipients

  • The following individuals are authorized to process Personal Data for the purposes described above,
  • any authorized Gojob employee in charge of managing and/or recruiting Gojobbers
  • any authorized Gojob employee in charge of managing the company's accounts and finances
  • employee representative bodies
  • our subcontractors
  • the partner/user companies of Gojob services (our customers)
  • external service providers and agents, Gojob consultants and consultancies or any third party involved in the process of preparing, concluding, performing or terminating the employment contract and/or of granting or paying benefits which Gojobbers are eligible for, including payroll service providers, insurers, private health insurance and/or social protection organizations, accountants and financial auditors, lawyers, court clerks, medical services and IT service providers
  • any future employer, particularly for requesting a reference
  • any governmental, administrative, judicial or regulatory authority
  • any person to whom a Gojobber authorizes Gojob to communicate his or her personal data.

5. How long do we keep your information? Retention period for your Personal Data

Generally speaking, Gojob shall retain:

  • If no jobs have been completed, the Personal Data related to your account on the Gojob platforms for two years from your most recent contact with us (accepting a newsletter or information text message, submitting an application, logging into your account, etc.)
  • Personal Data related to your jobs for the term of each corresponding contract in the so-called 'active' database and for the legal limitation period in a so-called 'intermediate' archive, or 6 years, that is accessible to a very limited number of people within Gojob, for the defense of Gojob's interests, to meet the requirements of the law, a regulation or a court order, or to cooperate in the context of an enquiry or legal proceedings.

5. How long do we keep your information? Retention period for your Personal Data

Generally speaking, Gojob shall retain:

  • If no jobs have been completed, the Personal Data related to your account on the Gojob platforms for two years from your most recent contact with us (accepting a newsletter or information text message, submitting an application, logging into your account, etc.)
  • Personal Data related to your jobs for the term of each corresponding contract in the so-called 'active' database and for the legal limitation period in a so-called 'intermediate' archive, or 6 years, that is accessible to a very limited number of people within Gojob, for the defense of Gojob's interests, to meet the requirements of the law, a regulation or a court order, or to cooperate in the context of an enquiry or legal proceedings.

6. How can you correct, update or make choices about the information collected about you that we are storing?

6.1 General.

If any of your Personal Data that we are storing changes, or if you no longer want to use our sites or services, you may correct, update, or delete information about you, or ask that it be removed from our sites, by contacting our Customer Service department or emailing us at dpo@gojob.com.

For some information, you may also log onto your Gojob account and make changes to your account settings. We will try to honor your request within 30 days. In some cases, we may not be able to delete your Personal Data, in which case we will let you know that we are unable to do so and why. For example, we may be required (by law or otherwise) to keep certain information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete any information, it will be deleted from the active database, but may remain in our archives.

6.2 Stopping Certain Communications from Us.

(i). Emails. We may communicate with you by email at various times about your account, registration and transactions, as well as regarding special offers and updates about new products and services. You can choose to stop receiving promotional emails from us at any time simply by following the "Unsubscribe" or "Manage Email Preferences" link at the bottom of any promotional email, or by logging into your account and changing your account preferences. Please note that you may not opt out of receiving non-promotional emails regarding your account, your registration or your transactions with us.

(ii). Service-Only Telephone Calls or Text Messages. By voluntarily providing your telephone number to us, you agree that we (including our affiliates and agents) can call or text you at that number to respond to your request for our services and to communicate with you regarding your account or your registration or a transaction with us. If you wish to stop receiving such service-only calls or texts at any time, you may do so by logging into your account and changing your account preferences; by contacting our Customer Service department ; or (for texts only) by responding "STOP" to any such text message.

(iii). Telephone Marketing Calls. If we have provided you with the option to consent to receive telephone marketing calls from us, please note that your consent to receive such promotional calls or messages is not required to use any of our products or services. If you have provided consent to receive telephone marketing calls from us, but you wish to revoke such consent, you may do so by any reasonable means, including by contacting our Customer Service department or emailing us at dpo@gojob.com and stating that you wish to revoke such consent.

(iv). Text Message Marketing. If we have provided you with the option to consent to receive promotional text messages from us, please note that your consent to receive such promotional text messages is not required to purchase or use any of our products or services, and that standard message and data rates may apply. If you have provided consent to receive promotional text messages from us, but you wish to revoke such consent, you may do so by any reasonable means, including by contacting our Customer Service department or emailing us at dpo@gojob.com and stating that you wish to revoke such consent, or by responding "STOP" to any such message.

Please note that while any changes you make will be reflected in active user databases instantly or within a reasonable period of time, we may retain all information you submit for backups, archiving, prevention of fraud and abuse, analytics, satisfaction of legal obligations, or where we otherwise reasonably believe that we have a legitimate reason to do so.

7. How do we secure information collected about you?

  1. We have implemented and follow reasonable industry standard technical and procedural measures (including encryption of certain information) intended to protect against unauthorized access and use of information collected in connection with the use of our sites and services. We maintain physical, electronic and procedural safeguards that comply with federal regulations and generally accepted standards to guard your nonpublic personal information, both during transmission and once we receive it.

HOWEVER, PLEASE NOTE THAT, DESPITE OUR BEST INTENTIONS, WE CANNOT FULLY ELIMINATE THESE RISKS, AS NO TECHNOLOGY IS COMPLETELY SECURE. OUR SITES ARE OPERATED ON DIGITAL NETWORKS, SOFTWARE, AND HARDWARE, ANY COMPONENT OF WHICH MAY, FROM TIME TO TIME, EXPERIENCE BREACHES OF SECURITY OR OTHER ISSUES BEYOND OUR CONTROL.

Accordingly, we cannot guarantee that any information we collect about you, whether during transmission or while stored on our systems or otherwise in our care, will be absolutely safe from intrusion by others who do not have your authorization. Any such transmission or sharing is done at your own risk.

You also play a role in protecting your Personal Data. Please do not share your username or password with others.

8. Do we share information about you with third parties for their own direct marketing purposes?

We do not disclose your Personal Data to third parties for their own direct marketing purposes without your consent.

9. What are our policies for cookies and similar technologies?

9.1 What is a cookie?

Cookies are files, often encrypted, which are stored on your browser. They are created for a limited period when a user's browser loads a specific website: the website sends information to the browser, which creates a text file. If you are a California resident and a user of our services, you can request a copy of this information from Gojob by sending an email to dpo@gojob.com. Please include your name and email address with your request. Gojob reserves the right to request additional Personal Data from you to confirm your identity before responding to this request.

We will not discriminate against you for exercising any of your rights under the CCPA or other applicable law.

11. What is our policy on the use of Gojob by children?

Gojob is not designed or intended to be used by children under the age of 18, and we do not knowingly collect personally identifiable information from children under 18. IF YOU ARE UNDER 18 YEARS OF AGE, PLEASE DO NOT USE ANY OF OUR SITES AT ANY TIME OR IN ANY MANNER.

If you learn that your child under 18 has provided us with personal information without your consent, please contact us. We will promptly delete that data from our systems.

12. What are the terms regarding any future changes to this Privacy Policy?

We reserve the right to update or modify this Privacy Policy from time to time, with any such changes to be effective prospectively. Please visit this web page periodically so that you will be apprised of any such changes. Your continued use of any of our sites and services after any modification to this Privacy Policy will constitute your acceptance of such modification.

13. What law governs any disputes regarding this Privacy Policy?

You agree that any dispute over privacy or the terms contained in this Privacy Policy will be governed by the law of New York and the U.S and will be subject to the terms and limitations of our General Terms and Conditions of Use.

If any provision of this Privacy Policy is judged to be illegal, void or unenforceable due to applicable law or by order of a court of competent jurisdiction it shall be deemed deleted and the continuation in full force and effect of the remainder of the provisions will not be prejudiced.
